The agreement on the use of LetVox.com
1. Subject of the Agreement
1.1. This Agreement is a contract of adhesion (hereinafter - Agreement), and is aimed at regulating relations between LetVox (hereinafter – Administrator), a legal entity registered and existing under the laws of Ukraine, the administrator of the portal www.letvox.com (hereinafter – LetVox.com) , and you - the individual Internet user (hereinafter - the User), considering the use of the Portal LetVox (hereinafter - the Portal) and other services placed on it (hereinafter – the Portal’s Services) and also regarding User’s sending the graphic, text and other messages.
1.2. Using the Services of LetVox.com the User agrees to abide by the terms of this Agreement. The use of certain Services may be governed by separate regulations, which are also part of this Agreement.
2. Term of use:
2.1. The User’s registration on the Portal or the actual use of any of the Portal’s Services testifies the user’s accession to the Agreement and confirms their unconditional acceptance of all the terms below.
2.2. The User’s Registration can be made either by filling in the registration form while creating an e-mail box, or by filling in any registration form while using one of the portal’s services. By registering on the portal, the User gives his consent to the processing (namely, collection, accumulation, organization, storage, updating, using, distribution, depersonalization, blocking and destruction) of their personal data by Administrator.
In the process of filling in the registration form the user chooses their own login and password required for further access to one of the e-mail boxes (rf.ua or letvox.com) or to the Portal’s Service, as well as an alternative e-mail and other depersonalized data, which (altogether) become their account (hereinafter – User’s account data), and allow the user to regain access to their e-mail box. The User confirms that they are informed that the safety of an e-mail box directly depends on the Password’s complexity (the number and the variations of characters) and the account data accuracy
2.3 After registration on the Portal, the User has access to a limited version of the Portal. The User is limited to listening of letters and files that do not exceed 1500 characters (news feed is the exception). To remove this restriction User can buy access to the full version of the Speaking portal.
2.4. The user is personally responsible for the safety and security of their password and in case of any unauthorized use of their password or account or any other threat to safety, should immediately notify the Administration of LetVox.com.
2.5. The User is solely and exclusively responsible for the content of their e-mail messages sent using the Portal.
2.6. The User agrees that they shall be solely responsible to the LetVox.com and third parties for all activities that occur using their mail box or account.
2.7. LetVox.com is not responsible for and does not guarantee the security of the electronic mail box of the User in the following cases:
- giving the password to third parties (either intentionally or by accident);
- third parties’ access to the user’s e-mail box using the software tools allowing selection and / or decoding the password;
- third parties’ access to the electronic mail box of a user by simply guessing the password;
- if the User doesn’t follow the recommendations of the Portal.
2.8. LetVox.com is not responsible for any delay, deletion or non-delivery of the e-mail.
2.9. The User agrees that LetVox.com can set the limits in using Portal’s services, this can involve the term of e-mail storage, the maximum number of messages that can be sent or received by one User; the optimal size of an e-mail and disc-space; the maximum number of calls to the e-mail box during a certain period of time, etc.
2.10. LetVox.com is not responsible for any data loss caused to the User as well as it’s not responsible for the User's use of electronic mail box for commercial purposes, including the storage of information (documents), business correspondence, as well as for any damages (lost profits), which can be caused to the user’s good name or non-material assets and any loss of data suffered by the User.
2.11.The User acknowledges and agrees that LetVox.com tries to ensure smooth functioning of the Portal, but at the same time LetVox.com has the right to carry out preventive work of portal’s services with a temporary suspension of the operation.
2.12. Portal’s Administration has the right to send the User messages that contain some service information about existing and new products and services, payments, technical activities, etc.
3. The ban on the use of portal services for:
3.1. The user to send a graphic, text and other messages that:
- Are illegal, harmful, threatening, harassing morality, slanderous, propagandizing hatred and / or discrimination against people based on race, ethnicity , gender, social grounds, infringing upon the rights of minority groups , as well as violating the accepted norms and ethics of communication on the Internet, or impeding the work other users of the Portal;
- Contain rude, obscene or abusive language, including pornographic material ;
- Violate the rights of underage and / or cause harm in any form, including moral character ;
- Violate any rights of third parties, including copyrights, trademarks, trade secrets, and / or aimed at the infringement of any other intellectual property rights of third parties;
- Contain viruses or any other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any computer or telecommunications equipment or software for unauthorized access to computer systems, equipment or data of third parties, as well as the serial numbers for commercial software and programs for their generation, logins, passwords, and other means to gain unauthorized access to sites on the Internet , and sending them in any form;
3.2. Sending e-mail messages that are promotional in nature , including bulk (more than 10 addresses), unauthorized and / or unexpected by the receivers, including the messages, with a lot of reps on one postal address ( "Spam "), as well as repeatedly sending emails to one recipient without their agreement.
3.3. To pretend being somebody else (using their email address or otherwise) or by any other means to give false information about themselves.
3.4. Creation or promotion of the pyramid schemes (including, but not limited to, projects involving direct cash payments to the User, except when the user has provided LetVox.com with information confirming the registration of such projects in the relevant bodies of financial supervision and the availability of all necessary permits) and materials of this nature, multi-level (network) marketing systems of online earnings and e-mail- businesses schemes, "chain letters".
3.5. The creation of several accounts by automated means either for fraud or deception, as well as for the sale, exchange, resale or use in any other way for any unauthorized commercial purpose;
3.6. Causing malfunction of the Portal;
3.7. Using automated scripts (programs) to collect information and (or) the interaction with the Portal;
3.8. The Administrator has the right to provide the appropriate state institution with User account data at their request.
4. The order of termination of the User's account
4.1. The User agrees that LetVox.com reserves the right to suspend, restrict or remove the user’s account at any time, without prior notification to the User and without explaining the reasons for such action, in the following cases:
a) violation of the Terms of this Agreement;
b) on the request of law enforcement and other authorities;
c) not using the account to access the electronic mail box by the User or any of the portal’s services for 12 months in a row;
d) due to unforeseen technical problems or circumstances related to the safety of the operation of the Portal.
4.2. Removal of User's account implies: removal of user’s access to all portal’s services; removal of the password, and emptying users' mail box from letters and files; deleting their personal settings.
5. General information and changes to the Agreement
5.1. Nothing in this Agreement shall be understood as establishing between the User and LetVox.com agency relationship, partnership relations on joint activities, hiring a personal relationship, or any other relations that are not provided directly by the Agreement.
5.2. The agreement is a legally binding contract between the User and the Administration
5.3. The recognition by the court of any provision of this Agreement as invalid or unenforceable shall not result in the recognition the other provisions of this Agreement as invalid or unenforceable.
5.4. Inaction on the part of LetVox.com, in case when the User, or other third parties break provision of this Agreement, does not preclude LetVox.com’s right to take appropriate actions to protect its interests later.
5.5. LetVox.com reserves the right to unilaterally amend the terms of the Agreement. The new version of the Agreement shall enter into force on the date of its posting on the portal.
5.6. User understands and agrees that if they use the Portal’s Services after the date when the changes and amendments to the Agreement have been posted, LetVox.com will treat the use of the Service as acceptance of the new conditions of User Agreement.
